Kea Cloud, Inc. (“kea”, “we”, “us”, and/or “our”) offers AI-powered, speech recognition software to the restaurant industry to facilitate automated telephone order intake . Our Privacy Notice explains how we handle the personal information we collect from and about individuals in connection with our business. This Supplementary Voice Data Privacy Notice (the “Notice”) provides additional information about how we treat voice data we collect from callers who interact with our technology when placing an order with one of our restaurant clients.

Information We Collect

When you call a restaurant that uses kea’s technology, you will be notified that the business uses automated voice ordering and that if you proceed, certain information about you will be collected, stored, and used on the restaurant’s behalf. Before placing your order, you will be asked to indicate whether or not you consent to the collection and use of this information.

If you do consent, kea’s technology will capture your voice, your spoken words, and the telephone number you are calling from (“voice data”).

How We Use Your Voice Data

We use the data described above to do the following:

  • Understand and interpret your order;
  • Deliver relevant responses;
  • Recognize you more quickly in the future, by comparing the number you are calling from against previously stored call data;
  • Personalize your experience, for instance, by quickly pulling up your past order history, favorite menu items, and dietary restrictions; and
  • Prevent and detect fraud.

We do not create voiceprints, which are unique mathematical representations of your voice, from your call. However, we may use transcripts of your interactions and audio recordings that do not directly identify you to develop and improve accuracy and performance of kea’s language processing features. 

Disclosure of Voice Data

Except for the limited circumstances described below, we do not share voice data with third parties except the restaurant client you ordered from, their point-of-sale service providers, and our trusted service providers which process your voice data only on our behalf to accomplish the purposes above. We do not sell, lease, trade, or otherwise profit from your voice data, except as described in this Notice.

We may share voice data between and among any current or future parents, subsidiaries, affiliates and other companies under common control and ownership with kea or with another company in connection with or during negotiations of any merger, acquisition, financing, re-organization, bankruptcy, sale, of all or a portion of our assets, or transition of services to another provider.

We may also share voice data to comply with a legal obligation; when we believe in good faith that the law requires it; at the request of governmental authorities conducting an investigation; to verify or enforce our legal agreements; or to respond to an emergency; or to protect the rights, property, safety, or security of our restaurant clients or the public.

Retention and Storage

We will collect, store, transmit, and protect your voice data using a reasonable standard of care that is at least as protective as the care kea uses when collecting, storing, transmitting, or protecting other confidential and sensitive personal information.

Audio recordings are kept for 30 days after your call and then destroyed, unless we need to keep them longer for legal purposes.
